Steps to File for Bankruptcy

Our Skilled Team of Lawyers Helps You Declare Bankruptcy

Helping Georgia clients live debt-free since 1993

After accruing too much debt, you may have looked into bankruptcy alternatives and determined that they weren’t right for you. Now you’ve decided that it’s time to file for bankruptcy, wipe the slate clean and start over. What do you do? Your first decision should be to speak with a bankruptcy attorney in Gainesville. At Jeff Field & Associates, our hard-working attorneys are ready to assist clients with a broad range of matters — from complex proceedings to understanding the basics of the law. When you’re ready for a “fresh start,” our team provides you with unparalleled legal guidance and support.

Georgia lawyers help you with the steps involved in filing for bankruptcy

Bankruptcy is one of the most complicated branches of law. As a result, it is imperative that you hire a lawyer who focuses on bankruptcy in Scottdale, Marietta, Athens or anywhere else in the area. You should rely only on the advice of an attorney who concentrates exclusively on bankruptcy, to provide you with the help you need. At Jeff Field & Associates, we can explain the following basic steps involved in filing for bankruptcy:

  • Consult with a lawyer. Your first step should be to speak to one of our attorneys. He can assess your situation and recommend whether you should file for Chapter 7, Chapter 13 or consider other alternatives.
  • Determine the type of debts you have. The type of debt you have will often determine the best option for you. For example, if you owe certain debts like alimony, child support and student loans, Chapter 7 may not be your best option, because these debts cannot be eliminated.
  • File a petition for bankruptcy. If bankruptcy is the best course of action, we complete and file the proper forms based on the information provided.
  • Attend meeting with creditors. You are required to attend a meeting with your trustee and any creditor who wishes to appear. Here you will discuss and answer any questions regarding your bankruptcy case. Of course, a lawyer from our office will be present at the meeting with you.
  • Obtain your discharge. Typically in a Chapter 7 bankruptcy case, you receive your discharge about 4 months after filing.

These are the basic steps involved in filing a bankruptcy case. In addition, you’re required to complete a 2-hour course concerning personal financial management before receiving a discharge. At Jeff Field & Associates, we strive to provide our clients with the knowledge and advice needed to overcome debt in a timely manner.
