Filing for Chapter 13 Protection

Bankruptcy can be a difficult bridge to cross but the benefits of the financial freedom it provides are usually well worth the risk. Many Debtors opt for the “fresh start” that Chapter 7 bankruptcy affords. However, there are numerous situations where a Chapter 13 bankruptcy is more appropriate, or even necessary.

If a debtor is behind on their house or car note, a Chapter 13 allows them to pay this arrearage back over the term of the bankruptcy (usually between three and five years). This allows a Debtor to save their house or vehicle from potential foreclosure or repossession.

Chapter 13 bankruptcy can also stop lawsuits and garnishments from attacking your wages. Filing for Chapter 13 protection immediately “stays” all actions against a Debtor and protects them from any future lawsuits while they are in their bankruptcy.
