Can I Afford a Lawyer to File for a Georgia Bankruptcy?

Needless to say, if someone is considering filing for a Georgia bankruptcy, money is tight. One of the most common questions that come up when prospective clients discuss bankruptcy options is their concern that they cannot afford a lawyer.

There are a few things to understand about the lawyer’s fee for a bankruptcy case. First, it is important to realize that bankruptcies vary in complexity from the very complex to the very straightforward. Secondly, the area of bankruptcy is competitive which helps to keep the cost down. Finally, the type of bankruptcy that you file can determine how much of the legal fee you are required to pay up front and how much you can pay over time.

When you file for a Chapter 13 bankruptcy the court will reorganize your debts by establishing a repayment plan that will typically last three to five years. At Jeff Field & Associates we usually include the legal fee in the repayment plan.

However, in a Chapter 7 bankruptcy, there isn’t a repayment plan so the attorney fee is paid directly to the lawyer. Many Georgia bankruptcy attorneys will accept partial payment

to start the case with the balance paid over time. This helps make the cost affordable for anyone who can’t pay the entire cost all at once. Most individuals, that are not able to pay the entire cost of the bankruptcy to start the case, pay as much as possible to minimize the amount of the remaining payment.

There are, of course, other options available for obtaining the attorney’s fee and other costs of the bankruptcy. Some debtors have loved ones to whom they can reach out to for assistance. In our experience, it is common for friends and family to be open to assisting with a permanent solution for financial problems, which bankruptcy can provide.

Finally, lawyers understand the financial hardship of the individual filing for bankruptcy and will make every effort to make the cost affordable.
