When you file for Chapter 7, the court issues an automatic stay, which prevents your creditors from contacting you to collect. Because Chapter 7 is called liquidation bankruptcy, many people have the impression they will lose everything if they file. Not true! The law allows you to exempt personal property in various categories, so you will be able to keep cars, clothing, furnishings, tools, jewelry, and other items up to the applicable limits. Debtors are even able to keep their homes in nearly every case. Then, in a few short months, the court discharges all your eligible debt.

Chapter 13 bankruptcy is for debtors with a regular source of income who can afford to pay something every month toward their debt. This is the bankruptcy chapter that helps homeowners who’ve fallen behind on their mortgage payments stop foreclosure and stay in their homes. You can also use Chapter 13 to keep your vehicle if it exceeds the state exemption limit. Just as with Chapter 7, you get an automatic stay as soon as you file. Then, we work closely with you to create a payment plan the court can approve. Your monthly payments will be less than your current bills, and you only need to continue the plan for three to five years, depending on your income. At the conclusion of your plan, the court discharges your remaining eligible debt.
