Chapter 7 is known as clean slate bankruptcy, because the court quickly discharges all eligible debt. As soon as you file, the court issues an automatic stay, prohibiting creditors from contacting you about your debts. Although the title to Chapter 7 is liquidation, selling some of your assets to partially repay your debts is very rare because the law allows you exemptions for clothing, home furnishings, jewelry, a vehicle, and other items, so most everyone is able to keep their possessions. Chapter 7 is not for everyone. You probably will not qualify if you earn far more than the state median income and you might be better off filing Chapter 13 if most of your debt is secured. But, when appropriate, Chapter 7 is a quick and effective way to eliminate eligible debt such as credit card balances, medical bills, and utility bills.
Chapter 13 is generally appropriate for folks who earn far more than the state’s median income for a household their size and who have secured debt such as a home mortgage. Chapter 13 does not provide a quick discharge; the court requires a payment plan, which we help you create, based on your monthly disposable income. Under the plan, you make one monthly payment, usually less than what you are currently paying. The money goes to a bankruptcy trustee who distributes funds to your creditors. You must continue with your plan for three to five years, after which, the bankruptcy judge discharges your remaining eligible debt. Chapter 13 is a slower road to debt relief, but if you want to stop a home foreclosure or repossession of a car, it is usually the best strategy.
