More Chapter 7 Hardship Discharges Being Granted for Student Loans

For years, student loan debt has been a serious burden for countless Americans, often preventing them from achieving financial stability and pursuing their dreams. You might have heard that discharging student loan debt through Chapter 7 bankruptcy is not possible. This is not quite true, however doing so has traditionally been an uphill battle. The stringent “undue hardship” standard, which requires borrowers to prove that repaying their loans would impose extreme financial difficulty on them, has made it nearly impossible for most to qualify. Filings seeking relief for educational debt increased by more than a third over the previous six-month period and a majority have been approved. Factors contributing to this trend could include the rising cost of higher education, inflation the economic challenges posed by the end of financial assistance measures enacted in the wake of the COVID-19 pandemic.

There is some support for legislation that would revise or eliminate the undue hardship requirement associated with education debt. This would make student loan obligations much easier to discharge in a Chapter 7 proceeding. However, it seems we are a long way from Congress deciding to put student loan debt in the same category as medical debt and credit-card balances.
