Chapter 13 is a consolidation and repayment form of bankruptcy for individuals with regular income. It provides protection from your creditors while allowing you to keep property and repay creditors in a manageable way. Based on the amount of your debts, income and living expenses, an attorney will help you establish a three- to five-year repayment plan. The plan payment amount is a set payment which is paid to a Chapter 13 Trustee, who distributes the money to your creditors. Chapter 13 bankruptcy is a good choice for individuals who have regular income, wish to retain property and repay their creditors in an affordable way.

An overview of the Chapter 13 process

  1. Contact Jeff Field & Associates to schedule a free initial consultation.
  2. Prepare your paperwork before coming in for your consultation. Visit our Getting Started page and fill out all appropriate forms. If you are married, make sure your spouse fills out these forms as well.
  3. Free initial consultation. An attorney meets with you to review your paperwork and determines which form of bankruptcy is right for you.
  4. Complete credit counseling courses. Prior to filing your Chapter 13 case, you must complete a credit counseling session, and after your case is filed, you must complete a financial management course. Both sessions are available online or by phone.
  5. Meeting of Creditors. Approximately one month after you file your case, you and one of our attorneys attend a hearing called the Meeting of Creditors. At this hearing, the Chapter 13 Trustee briefly reviews your case.
  6. Confirmation Hearing. The Bankruptcy Judge approves your repayment plan. Generally, you are not required to attend this hearing.
  7. Discharge. Upon completion of your repayment plan, you receive an Order of Discharge from the Bankruptcy Court.
