Giuliani’s Bankruptcy Case Shows Importance of Full Disclosure

After a Georgia defamation lawsuit resulted in a $148 million verdict against him, former New York City Mayor Rudolph Giuliani sought bankruptcy protection, claiming that he lacked the resources to pay the judgment and other debts. The fact that he owes such a large amount of money makes it easy to understand why he sought relief under Chapter 7, but instead of having his debts discharged, he appears to be providing an example of what not to do when it comes to disclosing required financial information. 

U.S. Bankruptcy Judge Sean Lane dismissed Giuliani’s Chapter 7 proceeding, citing several instances in which the former mayor did not comply with court orders. The dismissal means that Giuliani’s creditors, including the two Georgia plaintiffs, can now pursue him for the amount that he owes them. Specific instances cited by the court as evidence of his lack of transparency include the following:

  • Income that he earned from his radio show and other ventures was transferred to companies that he owned, but never reported to the court.
  • Giuliani did not notify the court that he had launched a line of “Rudy Coffee.”
  • After signing a book contract, Giuliani did not provide that information to the court in a timely manner.

The dismissal means that the man once known as “America’s Mayor” must wait at least 12 months to file for bankruptcy again.
