With Georgia Car Repossessions Rising, Bankruptcy Can Be a Lifeline

Car repossessions are surging across Georgia, due to defaults driven by inflation, rising insurance premiums and auto loans issued at historically high interest rates. For many individuals, a car is essential to earning a living, attending to essential needs and caring for loved ones. When monthly payments become unmanageable and the borrower defaults, repossession can occur swiftly, causing a major disruption in daily life. 

Fortunately, a Chapter 13 or Chapter 7 bankruptcy can be an effective tool for stopping repossession and restoring financial stability. The moment a case is filed, an automatic stay takes effect, preventing the lender from taking the vehicle or, if that was already done, requiring its return.

In a Chapter 13 bankruptcy, the debtor can propose a repayment plan that allows them to catch up on missed payments over time while keeping the vehicle. This is especially valuable for people who fell behind due to temporary hardship but might afford the loan going forward. Chapter 13 also allows for potential restructuring of the loan by lowering the interest rate or extending the repayment period. For vehicles purchased more than 910 days before filing, the debtor may even be able to reduce the loan balance to the car’s current value, a remedy known as a “cramdown.” 

Ideally, the debtor should file Chapter 13 prior to repossession of the vehicle. But it that has occurred, bankruptcy allows for return of the vehicle if the lender has not yet sold it. The repossessed vehicle is still considered the property of the bankruptcy estate. Because of that, the automatic stay prohibits selling it or continuing to hold it. The vehicle must be returned to the owner. Acting quickly can mean the difference between retrieving the car and losing it permanently. 

A Chapter 7 bankruptcy may be appropriate for individuals whose car loan is simply unaffordable due to their overall debt situation. For these debtors, surrendering the vehicle and wiping out the associated debt is the most realistic path toward long-term financial recovery. While Chapter 7 cannot force a lender to modify the loan, it can eliminate deficiency balances and discharge other debts. 

Bankruptcy is not just a last-resort option. It is a legal remedy designed to protect essential assets and give people a chance to regain their financial footing. For many Georgians, it is the most effective way to stop repossession and rebuild financial stability.
